Effective Date: January 1, 2026
These Terms and Conditions ("Terms") govern your use of the website operated by Vertex Oakley Asphalt Paving ("we," "us," or "our") at oakleyasphaltpaving.com, as well as your engagement with our services. By accessing this website or engaging our services, you agree to these Terms. If you do not agree, please do not use this site or our services.
By using our website, submitting a contact or estimate request, or entering into any service agreement with Vertex Oakley Asphalt Paving, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and customers. We reserve the right to update or modify these Terms at any time. Changes take effect when posted to this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
Vertex Oakley Asphalt Paving is an asphalt paving contractor providing services in Oakley, CA and surrounding communities. Our services include, but are not limited to, asphalt paving, sealcoating, crack sealing, pothole repair, parking lot maintenance, asphalt resurfacing, asphalt milling, grading and excavation, concrete curbing and sidewalks, drainage solutions, and related work.
The information on our website is provided for general informational purposes. Nothing on this website constitutes a binding offer or guarantee of service availability, pricing, or scheduling. All services are subject to a formal written agreement or proposal accepted by both parties.
Any estimate or quote we provide, whether in writing, by phone, or via our website, is based on information available at the time of assessment. Estimates are not binding contracts. Final pricing is confirmed in a written proposal or service agreement signed by both parties prior to work beginning.
Prices may change if the scope of work changes, if unforeseen site conditions are discovered during the project (such as base failure, drainage problems, or subsurface conditions not visible during the estimate visit), or if material costs change between the estimate and the scheduled service date.
We will notify you of any material change in scope or price before proceeding with additional work. You have the right to approve or decline any scope changes before they are performed.
Service appointments are scheduled based on availability. We reserve the right to reschedule work due to weather conditions, material availability, or other circumstances outside our control. We will provide as much notice as possible when a rescheduling is necessary.
If you need to cancel or reschedule a confirmed appointment, please notify us as soon as possible. Cancellations made less than 48 hours before a scheduled start time may result in a cancellation fee as specified in your service agreement. Any deposit paid may be non-refundable depending on the terms of your written agreement.
We may also cancel or decline to complete work if site conditions pose a safety risk, if access to the work area is obstructed, or if the scope of work has changed materially from what was agreed upon.
Payment terms are specified in your written service agreement. In general, a deposit may be required prior to scheduling, with the remaining balance due upon completion of work unless otherwise agreed in writing. We accept payment by check, cash, or other methods as specified in your agreement.
Invoices not paid within the timeframe specified in your service agreement may be subject to late fees as stated in that agreement. Accounts that remain unpaid may be referred to a collections process, and you may be responsible for reasonable collection costs including attorney fees where permitted by law.
Any dispute regarding an invoice must be communicated to us in writing within 10 days of receipt. Failure to raise a dispute within that period constitutes acceptance of the invoice as stated.
We stand behind our workmanship. Any warranty on materials or labor will be stated in your written service agreement. Where a warranty is provided, it applies only to work performed by Vertex Oakley Asphalt Paving and does not cover damage caused by third parties, vehicle traffic beyond the scope anticipated, acts of nature, soil movement, tree root intrusion, or failure to follow post-service care instructions.
THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, OR SUITABILITY OF ANY INFORMATION ON THIS WEBSITE. NOTHING ON THIS WEBSITE CONSTITUTES A GUARANTEE OF ANY SPECIFIC RESULT OR OUTCOME.
Asphalt and concrete surfaces are subject to natural wear, weathering, and the effects of underlying soil conditions. No paving contractor can guarantee that a surface will remain crack-free indefinitely, particularly in climates or soil conditions that place stress on paved surfaces. Normal weathering and minor surface wear over time do not constitute a defect in workmanship.
To the maximum extent permitted by applicable law, Vertex Oakley Asphalt Paving and its employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website, your reliance on any information provided on this website, or any service performed under a service agreement.
Our total liability to you for any claim arising out of or related to services performed shall not exceed the total amount paid by you for the specific service giving rise to the claim. Some jurisdictions do not allow limitations on liability, so this limitation may not apply to you in full.
